[00:28] for a white church van

[00:43] we are northbound on River Road just past Cannon.
[00:45] Show us following a vehicle
[00:46] possibly involved in felony hit-and-run 45 minutes ago.
[00:49] White Ford van with license plate
[00:51] nine, Eddie, three, seven, Larry, Peter. Requesting backup.
[01:18] Lower the window, then place your hands back on the wheel.
[01:25] Have you fellas found the woman? Is she okay?
[01:28] Sir, I smell alcohol. Have you been drinking?
[01:31] Oh, well…
[01:36] I… Sir, I’m gonna need you to step out of the vehicle.
[01:39] Keep your hands in front of you.
[01:40] But what about the girl?
[01:41] Step out of the vehicle, now.
[02:02] You can set your watch to it.
[02:05] 9:52, each and every Sunday morning.
[02:10] Benjamin Colón, Attorney at Law emerges
[02:13] from 9:00 mass looking
[02:15] renewed and refreshed.
[02:19] Monsignor Espinoza! Wow!
[02:22] Ah, I see you’re slumming it.
[02:24] Huh, what, they bump you back down to parish priest?
[02:26] Aren’t you supposed to be working the door
[02:27] – at St. Patrick’s Cathedral? – Hey, hey.
[02:29] Do not be a wise guy.
[02:31] Remember who I work for?
[02:32] Ah, indeed, indeed.
[02:34] So good to see you, Father.
[02:36] What brings you back down here?
[02:39] You.
[02:40] Your church needs your help, Benny.
[02:42] Mm. Promise you, Monsignor,
[02:45] I’m putting every dime I can spare in that plate.
[02:48] I mean professionally.
[02:50] One of our parish priests out on the end of Long Island,
[02:53] Father Andy Tincher,
[02:55] has been charged in a hit-and-run.
[02:57] Victim was a young woman out jogging with her sister.
[03:00] Yeah, I read about that. Absolutely tragic.
[03:04] But, I mean, what can I do?
[03:08] I have to believe the diocese’s attorneys have it all covered,
[03:12] and frankly, from everything I’ve read,
[03:14] the best move, maybe, is to get your guys in there
[03:17] and have them work out a plea deal.
[03:19] It’s-it’s a bit more complicated than that.
[03:24] They hit someone,
[03:25] drove right to this church, and then went to confession?
[03:29] No, no, it was a church van.
[03:31] Whoever it was, was driving a church van,
[03:33] so they drove straight back to the church,
[03:36] Father Andy saw whoever it was, saw that they were upset,
[03:39] got them to confess to him,
[03:41] then tried to get them to call 911.
[03:43] – And they wouldn’t? – Nope.
[03:46] Worse still, the driver didn’t even know
[03:49] if the victim was alive or dead.
[03:51] So Father Andy did the only thing he could do.
[03:55] So why didn’t the priest call 911?
[03:59] Well, the Confessional Seal demands that a priest
[04:01] never reveal anything disclosed to him during confession.
[04:05] Father Andy thought the victim might be
[04:08] suffering on the side of some dark road,
[04:10] so he got back in the van to find her
[04:13] and see if he could help.
[04:14] With a blood alcohol count of .09.
[04:18] Fine, he-he’s guilty of drunk driving,
[04:20] no one is disputing that, but the rest of it is exactly why
[04:24] Monsignor Espinoza needs our help.
[04:25] He knows how this is gonna sound to a jury.
[04:28] – Oh, Benny. – No, Bull,
[04:29] you’re not, you’re not hearing me.
[04:31] This isn’t just about a hit-and-run.
[04:33] This is about the Church… The Roman Catholic Church,
[04:37] the largest Christian church in the world…
[04:40] Going to court to protect the sanctity of confession,

[04:45] of the religion, and they want you and me
[04:47] to make that case for them.
[04:49] I feel terribly for the poor woman’s family.
[04:52] I mean, trying to grieve with all of this going on?
[04:54] I think it’s just best we focus on the defense, Father.
[04:58] As I’m sure you know, Father,
[04:59] as officers of the court, there are any number
[05:03] of privileges that we deal with.
[05:06] Attorney-client. Doctor-patient.
[05:09] But the Confessional Seal is considerably broader
[05:12] than what we’ve worked with before.
[05:16] So I just need to get a sense of how big a blind spot it is
[05:18] we’re dealing with here.
[05:20] Of course, of course. Fire away.
[05:23] So this someone, whose name you can’t share,
[05:28] hits the woman with the church van,
[05:31] comes back here and confesses.
[05:33] Yeah.
[05:35] And after that, how did they leave?
[05:39] Excuse me? I don’t follow.
[05:41] I-I think what
[05:43] Dr. Bull is asking is, what occurred
[05:46] after the sacrament of confession was performed?
[05:49] Maybe there are some things that you can tell us,
[05:51] without… violating the Seal, that can help us
[05:54] find the person who actually did this.
[05:57] I mean, wouldn’t that be the best
[05:59] outcome for all of us?
[06:05] I don’t think I’m gonna be much help here.
[06:09] I mean…
[06:11] if this had occurred
[06:13] in the confessional booth,
[06:17] I couldn’t divulge information about the confessor
[06:19] as they left the church
[06:21] because they’re on the other side of the curtain.
[06:23] It’s designed that way on purpose.
[06:26] I’m not supposed to see who’s offering the confession.
[06:30] But this confession
[06:31] didn’t take place in a confessional booth.
[06:33] It was in the church driveway.
[06:37] I don’t think where you confess makes a difference to God.
[06:43] Have you had any contact with the driver
[06:45] since he or she made the confession?
[06:48] It feels like these questions are really all just an effort
[06:53] to get to the identity of the confessor,
[06:56] which you have to understand,
[06:57] I’m not at liberty to disclose.
[07:00] I mean, not without violating the spirit
[07:02] of the Confessional Seal.
[07:04] Father Andy, I don’t know what to tell you.
[07:07] You were caught
[07:09] in the van with the victim’s blood on it.
[07:11] You were drunk.
[07:13] You’re being charged with vehicular manslaughter,
[07:15] leaving the scene of an accident,
[07:17] and driving under the influence.
[07:18] The prosecution has a very strong case.
[07:20] Now, I’m not asking you to break your vows
[07:22] or the Confessional Seal,
[07:24] but I can’t defend you if you won’t help defend yourself.
[07:28] Huh?
[07:30] You just… you got to give me something to work with.
[07:35] I’ll understand if you can’t help me.
[07:39] Will you really?
[07:40] You’re willing to spend 15 or 20 years in prison
[07:43] for something you didn’t do?
[07:45] Do you believe in God, Dr. Bull?
[07:49] Well, when I’m on a plane
[07:52] and there’s a lot of turbulence,
[07:53] I sometimes wish I’d gone to church a bit more,
[07:56] but day in and day out?
[07:57] Confession is a… is a gift of grace
[08:01] and a way back to God for those who are lost.
[08:04] It saves lives and souls.
[08:09] I understand.
[08:10] This is not a choice for me, gentlemen.
[08:13] I mean, confession’s not an obstacle to overcome
[08:16] so you can catch whoever did this.
[08:18] It’s-it’s an essential step on the path to redemption
[08:22] for that tortured soul who killed that woman.
[08:25] So, no.
[08:27] I can’t give you something to work with.
[08:31] I’m doing the only thing
[08:33] I know how.
[08:34] I’m putting my trust in God.
[08:50] Thing that makes turbulence so frightening
[08:52] is you never see it coming.
[08:58] Mr. Colón and I would be pleased to represent you, Father.
[09:02] *BULL (2016)* Season 03 Episode 10
[09:04] Episode Title : “A high LAW”
[09:06] Captioning sponsored by CBS
[09:07] Captioned by Media Access Group at WGBH access.wgbh.org
[09:09] Synchronized by srjanapala
[09:11] Ah. Don’t think I’ve ever tried a case in Suffolk County.
[09:15] Well, that’s the judge, uh, there’s the jury,
[09:18] – and we sit here. – Mm.
[09:21] All right. So what’s the plan?
[09:24] Win.
[09:26] Well, we need to make sure whoever ends up in that jury box
[09:30] understand the only reason Father Andy was in that van
[09:33] was because he made a solemn vow he could not break.
[09:36] Well, that doesn’t sound so tough.
[09:38] People understand vows.
[09:40] Marriage vows…
[09:42] Well, you would be surprised.
[09:44] For most people, the idea of going to prison
[09:46] just to keep a promise, that’s gonna be a tough sell.
[09:50] And it’s not like we can put Father Andy on the stand.
[09:52] Why not? I can’t imagine a more trustworthy witness.
[09:56] Well, the problem is he’s not gonna be able to answer
[09:58] the questions the other side is gonna ask,
[10:00] and the jury’s gonna hold that against him.
[10:01] They’re gonna feel like he’s hiding something, which he is.
[10:06] Even if it’s for the right reasons?
[10:07] Trust me, it’s human nature.
[10:09] If someone’s got a secret, we want to know what it is.
[10:13] What about these jurors?
[10:15] I’m assuming we’re looking for Catholics,
[10:16] or at the very least, regular churchgoers?
[10:19] Not necessarily. Believe it or not,
[10:21] church attendance is not always such a great indicator
[10:25] of a person’s spiritual life.
[10:27] I see that you attend Hope Baptist Church?
[10:30] 17 years. Every Sunday.
[10:33] That may be what she’s doing
[10:35] on Sundays, but the rest of the week,
[10:36] she’s having an “emotional affair” via text
[10:39] with a man from Albuquerque she’s never met,
[10:41] and who her husband is totally unaware of.
[10:47] What we want are moral objectivists.
[10:50] Jurors with a strong internal code
[10:52] that doesn’t change with societal whims
[10:54] and bureaucratic rules.
[10:56] They’re duty bound, they know the value of a secret,
[10:59] and more importantly, expect everyone to keep their word.
[11:03] Good morning, sir.
[11:04] I see, from your jury questionnaire
[11:06] that you have a 14-year-old daughter.
[11:08] I do.
[11:09] By any chance, does she keep a diary?
[11:12] – She calls it a journal. – Ah.
[11:14] You ever think about looking at it?
[11:16] Reading it?
[11:18] No. That’s not…
[11:20] What if
[11:21] you were worried about her?
[11:23] Something going on behaviorally
[11:25] and she won’t talk to you about?
[11:27] No. I couldn’t.
[11:30] It’s hers.
[11:31] Your Honor,
[11:33] this juror is acceptable to the defense.
[11:35] And this is my domain.
[11:39] Is this where someone would come
[11:41] if they wanted to check out the van?
[11:43] If we still had one,
[11:45] and you wanted to use it, this is where you would come.
[11:48] And the drivers?
[11:50] Well, there’s Father Andy, of course,
[11:53] and me, and eight others are authorized to take it.
[11:57] I’ll get you the names.
[11:59] How do you keep track of who has the van at any given time?
[12:02] Oh, well, every trip is entered on the calendar.
[12:08] We don’t want our choir stranded
[12:10] because someone decided to get groceries for the kitchen.
[12:13] And the key?
[12:15] We keep it in here.
[12:17] Only authorized drivers are given the combination.
[12:20] And we have this log,
[12:23] which is where they’re supposed to sign out
[12:25] whenever they take the key.
[12:26] Unfortunately, no one signed out
[12:29] the night of the accident.
[12:32] Oh, my gosh!
[12:34] There he is.
[12:35] Jacob. Harvard?
[12:38] Oh, that is amazing.
[12:40] I have been praying you would hear good news.
[12:42] Thanks. Yeah, yeah, yeah.
[12:44] In the meantime, we’re all starving here.
[12:46] Pizza should be arriving any minute.
[12:48] I’ll get you your petty cash.
[12:53] Oh. Give me a second.
[13:09] I understand you also had an opportunity to examine
[13:11] the vehicle involved, the St. Bernadine’s church van?
[13:15] Yes, I did.
[13:16] And this wasn’t your first encounter
[13:18] with this particular vehicle, was it?
[13:21] No.
[13:22] Can you tell us about it?
[13:25] I stopped to assist Father Andy two years ago.
[13:28] He was in the same van
[13:30] on the side of the road with a flat tire.
[13:31] Was there anything unusual about this interaction?
[13:38] He had clearly been drinking.
[13:41] Your Honor?
[13:43] May we approach?
[13:46] Your Honor,
[13:47] this is impermissible character evidence.
[13:50] We all know that the prosecution isn’t permitted
[13:53] to prove conduct through a prior bad act.
[13:55] Defense counsel asserted in his opening statement
[13:57] that the defendant never would have driven drunk
[13:59] but for the alleged confession.
[14:01] He opened the door to this.
[14:02] We’re permitted… In fact, we’re obligated…
[14:04] To refute that defense.
[14:07] I’m gonna allow it.
[14:13] And did you arrest the defendant at that time? Cite him?
[14:18] No.
[14:20] He was a priest, and I felt sorry for him,
[14:22] so I drove him back to the church.
[14:24] No further questions, Your Honor.
[14:27] So how bad is it?
[14:29] How bad would you like it?
[14:31] We’ve lost them all.
[14:32] Not a single green in the bunch.
[14:38] I never put it together.
[14:41] Not even when the officer took the stand.
[14:44] I-It’s not like he, he asked me if I’d been drinking, or…
[14:47] It’s not like he gave me
[14:49] a breathalyzer test.
[14:50] I-I was trying to change a tire and he came over to help.
[14:53] And, like, a minute in, he said,
[14:57] “How about I just give you a ride back to the church?”
[15:00] I’m guessing he could smell it on you.
[15:02] It’s not like that. I-I’d come from a wedding.
[15:05] No. Sorry. It is like that.
[15:08] You’re on trial for murder, for killing a young woman
[15:11] while driving under the influence.
[15:13] I wasn’t drunk.
[15:14] I think I’d had two glasses of wine. Maybe three…
[15:17] Father Andy, we really need to know,
[15:20] are there gonna be any other surprises?
[15:22] No. I’m certain of it. No.
[15:24] Unfortunately, Officer Avery’s testimony made it sound
[15:27] like this was a pattern of behavior.
[15:30] I’m gonna need you to take the stand.
[15:32] Uh… what would be the point?
[15:35] I mean, what would you want me to say?
[15:39] The truth.
[15:41] I need you to talk about the night of the flat tire.
[15:43] There’s no confession involved.
[15:46] You don’t need to talk about anybody but yourself.
[15:48] It’ll give the jurors a chance to see who you really are.
[15:52] That you’re forthcoming.
[15:54] That you’re not afraid to take the witness stand,
[15:56] and most importantly,
[15:58] that you’re not someone who normally drinks and drives.
[16:05] And what happens if they start asking about the hit-and-run?
[16:09] We’ll invoke the cleric-penitent privilege.
[16:11] What choice do we have?
[16:13] So,
[16:15] at this particular reception,
[16:16] how many drinks would you say you had?
[16:19] Two.
[16:21] Maybe three… glasses of wine.
[16:23] Two? Maybe three?
[16:25] You don’t remember?
[16:27] I mean, w-was it two or three?
[16:29] Well, truthfully, I can’t be sure.
[16:32] It was over two years ago.
[16:34] Well, you testified that you-you really don’t drink that often.
[16:38] So I would think that you would remember if it was two or three.
[16:41] Maybe I’ll just answer “three” next time.
[16:46] Ask me something else.
[16:48] So it’s your testimony, Father,
[16:52] that the only two times
[16:55] that you’ve been stopped by law enforcement
[16:57] happened to also be the only two times that you’ve drank
[17:01] and then got behind the wheel of a car?
[17:03] I-I… Now, I know how that sounds.
[17:06] I’ve-I’ve heard all the stories and all the jokes about
[17:10] drunken priests.
[17:16] Go to a wedding, everybody’s dressed up,
[17:19] everybody’s there to have a good time.
[17:22] And there I am, with my collar and my vows and my Bible,
[17:26] and I’m-I’m a-a silent reminder
[17:30] to everyone, uh, not to have too much fun.
[17:33] Not to have too good a time.
[17:37] And what I’ve discovered over the years is that
[17:40] if I’m holding a glass of something…
[17:43] I-if I’m holding a glass of anything…
[17:47] People relax a little bit.
[17:48] They-they forget a little bit.
[17:52] Okay. That’s better.
[17:55] That’s warmer, it’s a touch more human.
[17:59] But frankly, the jury doesn’t want to hear excuses,
[18:02] or that you drink to make them feel more comfortable.
[18:05] A woman is dead.
[18:07] And you know what happened and you won’t tell anyone
[18:10] and you’re asking for a pass.
[18:13] And so what I want in return… What, what they want in return…
[18:17] Is to feel that they know you.
[18:19] To feel that they can trust you.
[18:21] Okay. How do I do that?
[18:23] Take ownership of your mistakes.
[18:26] “I drank too much. Period.
[18:29] “I should not have driven myself home. Period.
[18:32] “I vowed to never do it again.
[18:35] “Period. The night of the hit-and-run
[18:36] “is a completely different thing. Period.
[18:39] “There was a woman on the side of the road who needed help
[18:42] and I was determined to help her. Period.”
[18:49] Is this the way you always do it,
[18:52] prepare people for court?
[18:55] I mean, you raise your voice?
[18:56] You taunt them?
[18:59] Or is this just for me?
[19:01] No.
[19:04] I have a complicated relationship
[19:06] with organized religion,
[19:08] and I think I projected that onto you.
[19:11] Hmm.
[19:12] Well, you’re in good company.
[19:14] A lot of people have problems with organized religion.
[19:18] No, I don’t have a problem with organized religion.
[19:22] It has a problem with me.
[19:25] Catholic?
[19:27] Baptist.
[19:29] Hmm.
[19:32] I went every Sunday.
[19:35] I started singing in the choir in eighth grade.
[19:45] Those were tough years for me.
[19:48] I carried around a lot of shame.
[19:57] I wasn’t sure who I was,
[20:00] and when I started getting surer, I wasn’t sure I liked it.
[20:06] I can’t count the number of nights that I’d go to sleep
[20:09] praying to God that he would fix me.
[20:15] It was pretty clear that…
[20:18] I was no longer welcome.
[20:24] And I got to admit…
[20:28] I miss it.
[20:35] But now I guess you could say
[20:37] that my relationship with God is my own.
[20:42] Hmm.
[20:45] Well, good for you.
[20:48] I’m glad you didn’t give up on God
[20:50] because your church gave up on you.
[20:56] Now, ask me another question.
[21:00] I’m telling you,
[21:02] anyone could have taken that van key, authorized or not.
[21:05] Well here’s a crazy idea.
[21:06] What if we forget about the who.
[21:08] Maybe just concentrate on the where.
[21:10] I’m not following.
[21:12] Well, I was thinking, if I could just figure out
[21:15] where the van had been and where the van was heading,
[21:17] it might help us identify the driver.
[21:19] – You can do that? – Already did.
[21:21] The van has an onboard navigation system,
[21:23] which I was able to access remotely.
[21:25] The cool thing is, any time the vehicle is on,
[21:28] the system notes and records its location
[21:30] whether you’re asking it for directions or not.
[21:33] We know the location of the hit-and-run.
[21:35] So what I’ve been doing is looking for other trips
[21:37] that used that road, passed by that location.
[21:40] And…?
[21:42] And I found two others.
[21:44] Both stopped at the same address.
[21:46] Do they correlate with any other entries in the log pages?
[21:50] They do not.
[21:51] If you give me that address, I’ll go over and check it out, see what I can find out.
[21:54] Just e-mailed it to you.
[21:55] So Officer Avery didn’t actually administer a breathalyzer test?
[22:00] No. He didn’t.
[22:01] Or conduct any kind of field sobriety testing?
[22:04] No. Uh, but I-I still think Officer Avery
[22:08] did the right thing, driving me home.
[22:11] I’d had a few glasses of wine.
[22:14] And, uh, I-I really shouldn’t have driven.
[22:19] It was a mistake, and one that I don’t take lightly.
[22:23] I don’t make a habit of drinking and driving.
[22:27] Although, I-I do understand how it must look.
[22:30] And yet, you did drink and drive
[22:33] on the night of Ms. Newhouse’s death.
[22:35] Yes, I did.
[22:37] And I plead guilty to that.
[22:41] Father, can you please explain to the court
[22:44] how you ended up behind the wheel of the van that night?
[22:49] I was in my office.
[22:51] Uh, typically,
[22:53] Thursdays are the only night that, uh,
[22:56] I have any time to myself.
[22:59] I have a Scotch.
[23:01] I started to read.
[23:03] A window was open
[23:06] and I heard the parish van drive up behind the rectory.
[23:09] I didn’t remember there being anything scheduled.
[23:13] To be honest, I didn’t even know that someone had taken it.
[23:16] So I walked down to see who it was.
[23:20] And what did you find?
[23:22] The driver… this person…
[23:25] Was very upset.
[23:27] Panicked.
[23:29] And they confessed to me
[23:31] that they had struck a woman with the van.
[23:35] And what did you do?
[23:38] I gave absolution.
[23:40] And then I pleaded with the driver to call 911.
[23:45] And did they?
[23:48] The person… the-the driver…
[23:51] They were pretty distraught.
[23:53] They were quite hysterical.
[23:55] And I realized that this person
[23:58] was not capable of making that call.
[24:00] So did you make it?
[24:02] Did you call 911
[24:04] when the driver refused to?
[24:06] No.
[24:07] No. The Confessional Seal can’t be broken.
[24:11] So I couldn’t.
[24:13] And all I kept thinking about
[24:14] was this woman that I had just heard about.
[24:17] And I-I had a… only a vague description
[24:21] of where all of this happened.
[24:25] And the only thing I could think to do
[24:26] was to get in the van and go look for her myself.
[24:30] Father Andy…
[24:33] were you driving the van
[24:35] when it struck and killed Morgan Newhouse?
[24:40] When you called me up here,
[24:43] you had me place my hand on the Holy Bible.
[24:46] And I swore that I would tell the truth.
[24:49] So here it is.
[24:54] I was not in that van when it struck poor Ms. Newhouse.
[24:58] And I certainly was not driving that van when it struck her.
[25:02] I did get in it and go look for her.
[25:06] And I had a drink shortly before.
[25:14] I know how much it must ache
[25:17] not to know what happened.
[25:19] I know how it pains me
[25:21] not to be able to tell you.
[25:23] But God has a plan.
[25:25] I believe that with all my heart.
[25:29] Thank you, Father.
[25:31] No further questions, Your Honor.
[25:36] Drumroll, please…
[25:38] They like him.
[25:39] They sense he’s telling the truth.
[25:41] We’ve won back three jurors.
[25:44] Hmm.
[25:47] Father Andy…
[25:49] let me make sure I understood you.
[25:51] On the night in question,
[25:53] you went down to the van.
[25:55] This alleged driver did not seek you out. Is that correct?
[25:57] Yes, that’s correct.
[25:59] Okay, then.
[26:00] Now that we’ve cleared that up,
[26:02] I have just one question for you.
[26:04] If you weren’t driving the van that killed Morgan Newhouse…
[26:08] who was? Objection!
[26:09] Your Honor, as we’ve previously established,
[26:12] this information is protected
[26:14] by the cleric-penitent privilege.
[26:16] I disagree, Your Honor.
[26:18] Would the attorneys please approach the bench?
[26:24] Your Honor, based on Father Andrew’s testimony
[26:27] just moments ago, the privilege doesn’t apply in this case.
[26:30] To meet the legal threshold,
[26:31] the penitent must be intentionally seeking
[26:33] spiritual guidance and absolution.
[26:35] Your client just admitted
[26:37] that it was he who sought out the driver,
[26:38] not the other way around.
[26:39] Well, that’s ridiculous.
[26:41] It’s obvious what the intent of the law is, Your Honor.
[26:45] Mr. Colón, I understand your argument,
[26:48] but since the language of the statute
[26:50] doesn’t support your position,
[26:52] I’m going to have to side with Mr. Madden.
[26:55] I’m sorry, but no privilege will be granted
[26:58] with regard to your client’s testimony.
[27:03] I sense some turbulence coming.
[27:07] The witness is instructed to answer the question.
[27:14] I’m sorry, Your Honor.
[27:16] I cannot answer.
[27:17] Father Andy,
[27:19] the court ruled
[27:20] that the clergy-penitent privilege doesn’t apply.
[27:23] For the second time,
[27:24] you are instructed to answer the question.
[27:27] Again… I apologize to the court…
[27:31] But the Confessional Seal forbids it.
[27:35] My vow to the Church forbids it.
[27:36] My oath to God forbids it.
[27:39] This is your last chance.
[27:41] If you don’t answer the question,
[27:43] I will be forced to hold you in contempt of court.
[27:47] I’m sorry.
[27:50] I answer to God and the Vatican.
[27:53] Unfortunately for you, this is not a court of God.
[27:56] This is a court of law.
[27:57] I’m holding you in contempt of court.
[28:01] And because you won’t allow yourself to be cross-examined,
[28:03] your previous testimony
[28:05] is stricken from the record.
[28:06] Ladies and gentlemen of the jury,
[28:08] I instruct you to disregard the testimony of the defendant
[28:10] in its entirety.
[28:11] You will not consider anything he said
[28:14] in your deliberations.
[28:16] Take this man into custody.
[28:28] I sought out this firm’s help
[28:31] for one reason and one reason only.
[28:33] The Church is committed to protecting
[28:35] the sanctity of confession.
[28:39] We cannot and we will not allow a secular court
[28:44] to render 20 centuries of Catholic sacrament irrelevant.
[28:50] Monsignor…
[28:51] But as this trial has commenced,
[28:55] it has degenerated
[28:57] from a reasoned conversation
[29:00] about a treasured Catholic sacrament
[29:03] into something else entirely.
[29:05] Into a spectacle.
[29:08] The news is filled
[29:09] with revelations of drunk driving.
[29:13] A Catholic priest
[29:15] paraded before the press in handcuffs.
[29:18] A growing public belief
[29:22] that the Church is harboring a priest
[29:26] who is wielding confession as a shield
[29:30] behind which to hide his own criminal behavior.
[29:35] Well, w-we know how it looks, but…
[29:37] the trial isn’t over yet.
[29:39] It is.
[29:41] For us.
[29:45] I am sorry, gentlemen.
[29:47] I know how hard you’ve worked.
[29:49] – You’re firing us. – No.
[29:51] I am directing you to negotiate a plea.
[29:55] The quicker the better.
[29:56] The sooner this case
[29:58] is no longer a part of the public conversation,
[30:00] the better it will be for everyone.
[30:02] Except possibly Father Andy.
[30:04] The man’s innocent.
[30:06] Really?
[30:07] You still believe that,
[30:08] after everything we heard in that courtroom?
[30:10] And you wonder why you don’t see me in church on Sundays.
[30:12] It’s guys like this.
[30:13] They’re with you through thin and thin.
[30:16] Don’t you dare judge me.
[30:21] I have
[30:23] 296 parishes
[30:28] to worry about.
[30:29] Hey, Benny. Help your friend out.
[30:31] I think he’s looking for the high side of the boat.
[30:33] It’s out that door, down the elevator
[30:36] and right out onto the street.
[30:37] And just to be clear…
[30:39] whether you pay our bill or not,
[30:40] Benny and I are going to be representing Father Andy
[30:43] in court, defending his innocence.
[30:45] Because… and this might be a novel concept,
[30:49] but when we make a promise,
[30:52] when we make a pledge…
[30:55] we keep it.
[31:09] Oh, relax.
[31:10] You’re going to be fine.
[31:11] It’s me.
[31:12] I’m going to hell.
[31:15] But then again, I always was.
[31:21] – Yes? – Hi. Sorry to bother you.
[31:23] My name’s Danny James.
[31:24] I’m an investigator working on behalf of Father Andy
[31:27] from St. Bernadine Church.
[31:29] I’m trying to track down some information on a hit-and-run
[31:31] that occurred a few weeks back on River Road.
[31:33] Oh, of course. I read about that, yeah.
[31:35] Have you seen this vehicle?
[31:37] We have reason to believe it was actually
[31:39] parked in front of your house
[31:40] a little over a month ago.
[31:41] Yeah.
[31:42] Uh, Jacob drove it here.
[31:44] I think that’s his church’s.
[31:46] They let him drive it sometimes.
[31:47] Jacob?
[31:48] Jacob Larson.
[31:50] Oh, um…
[31:52] We met at church camp last summer.
[31:57] He doesn’t go to my school or anything,
[31:58] but we started hanging out after that.
[32:01] Do you still see him?
[32:02] No.
[32:04] Not for a few weeks, actually.
[32:07] It wasn’t serious or anything.
[32:09] Or… maybe I thought it was more serious than he did.
[32:14] So, You don’t see him anymore?
[32:16] He got into Harvard.
[32:17] And I guess it kinda changed him.
[32:20] How so?
[32:22] Well, the day he got the letter, he called me.
[32:25] He was super excited, because he got in. He got in!
[32:28] And, um, he wanted to come over that night and celebrate.
[32:33] And then he just didn’t show up.
[32:36] And you haven’t talked to him since?
[32:38] I… called him.
[32:40] I texted him. I even DM’d him on Instagram.
[32:44] And… nothing.
[32:48] Whatever.
[32:49] I’m over it.
[32:51] And as it happens,
[32:52] the quickest route from St. Bernadine’s
[32:54] to Jessica’s house is River Road.
[32:56] So Jacob would have driven right by the scene of the accident.
[33:01] Taylor, when did those Harvard early admission notices go out?
[33:04] E-mail notifications went out Thursday the 29th.
[33:08] Same day as the hit-and-run.
[33:10] So…
[33:11] Jacob gets into Harvard. He’s thrilled.
[33:14] He’s on his way over to see his girl,
[33:16] he hits Morgan. He panics.
[33:18] Turns around, heads back to the church,
[33:19] and afterwards, he is scared and guilt-ridden,
[33:22] and cuts off all contact with Jessica.
[33:24] So… we cracked the case, right?
[33:28] Still waiting for our “attagirls.”
[33:31] Well, I wouldn’t say you cracked it.
[33:33] More like dinged it a little.
[33:35] It’s great, but not enough to save Father Andy.
[33:38] – But we know who did it. – No.
[33:41] No, actually, we don’t.
[33:42] It’s just a theory.
[33:44] We can’t actually prove anything
[33:46] other than this Jacob got into Harvard.
[33:51] What else do we know about this Jacob?
[33:53] Lives with his mom, straight-A student.
[33:56] Spends a lot of time at church
[33:57] and volunteering, and has never been in trouble.
[33:59] So he’s a good kid.
[34:01] Not a cold-blooded killer.
[34:03] Just someone who made a horrible mistake.
[34:06] Got to be… scared.
[34:09] Riddled with guilt.
[34:11] Dying to talk.
[34:13] So what are you thinking?
[34:14] I’m thinking this kid confessed once before;
[34:17] maybe we can get him to do it again.
[34:29] Can I help you?
[34:31] Funny, I was about to ask you the same thing.
[34:33] Uh, I think you might be in the wrong place.
[34:35] I’m setting up for a youth group.
[34:36] There’s a bulletin board outside in the hall
[34:38] that lists everything else that’s going on.
[34:39] Nope. I’m in the right place.
[34:43] You’re Jacob, right?
[34:45] My name’s Dr. Jason Bull.
[34:47] I’m part of Father Andy’s legal team.
[34:51] I don’t know if you’ve heard,
[34:52] but things aren’t going very well.
[34:54] How do you mean?
[34:56] He’s a priest.
[34:57] – Everyone knows he would never… – Everybody knows what they’re told. Hmm?
[35:02] Father Andy was driving the van.
[35:05] He’d had a drink, and a woman died.
[35:08] The only real question is: will he go to prison
[35:12] for 15 years or will it be 20?
[35:15] Will he die in prison or will he live long enough to get out
[35:21] and have a few years of freedom?
[35:25] My guess is it was a horrible accident.
[35:28] What’s your guess?
[35:33] It was an e-mail from Harvard’s Office of Admissions.
[35:37] It said that I got in.
[35:40] Harvard.
[35:41] That’s quite an accomplishment.
[35:44] You must have been very excited, very proud.
[35:47] I was.
[35:50] And I was really grateful.
[35:53] I had got a lot of help.
[35:55] Encouragement from… my mom.
[35:58] People at the church.
[36:01] I’m the first person in my family to go to college.
[36:05] Or, uh, would have been.
[36:08] I’m guessing you wanted to celebrate.
[36:11] I was dating this girl, Jessica.
[36:16] I thought maybe we could do something.
[36:20] Nothing big, you know. Just… hang out.
[36:24] I didn’t have any money for an Uber or a taxi,
[36:29] or anything.
[36:30] And I… St. Bernadine’s is just down the street.
[36:34] And I knew the van would be there.
[36:36] And that wasn’t the first time you borrowed the van, was it?
[36:39] No, I had…
[36:42] taken it twice before to see Jessica.
[36:45] And what happened after you borrowed the van?
[36:52] I was driving…
[36:55] and I got a text.
[36:58] It wasn’t even… really for me.
[37:01] It was just an ad for some stupid game.
[37:06] And there was a thud.
[37:10] At first I thought it was a deer.
[37:15] But then I looked up.
[37:19] And what did you do?
[37:25] I didn’t do anything.
[37:28] I knew I should, I should get out.
[37:31] Help her, but…
[37:33] I didn’t.
[37:35] So you just sat there.
[37:38] I turned around…
[37:41] and I started driving back to the church.
[37:44] I just…
[37:47] I wanted to get out of that van.
[37:51] I wanted to make it not have happened.
[37:55] I’d just gotten the best news of my life.
[37:58] So you got back to the church…
[38:01] And I’m standing in the parking lot.
[38:04] I’m looking at the dent.
[38:07] The blood.
[38:11] And there’s Father Andy.
[38:13] It was like God had already told him.
[38:20] He said God would forgive me for anything,
[38:23] but I needed to confess.
[38:27] So I did.
[38:30] And then, he tried to get me to call the police.
[38:34] But all I could think of was my mom and my friends
[38:39] and my future.
[38:42] I’m… so, so sorry.
[38:46] I-I never meant to hurt your sister, your daughter.
[38:50] Anyone. Not my mom.
[38:53] Not Father Andy.
[38:56] No further questions, Your Honor.
[38:59] Mr. Madden, any questions?
[39:05] Your Honor, in light of this testimony,
[39:08] we’d like to dismiss the charges against Father Andrew Tincher.
[39:12] And we’d also like to seek an arrest warrant
[39:14] for Jacob Larson in the felony hit-and-run of Morgan Newhouse.
[39:18] So ordered.
[39:35] Just so you know, we’re gonna do everything we can
[39:37] to get Jacob the best deal possible.
[39:42] You’d think after all these years,
[39:44] I’d have a better grasp on how God works.
[39:49] Still a mystery.
[39:52] I was watching Jacob on the stand,
[39:54] and I… I just kept wondering
[39:58] maybe I’m just supposed to plead guilty.
[40:03] You don’t really believe that.
[40:06] But you were willing to do it, weren’t you?
[40:09] Give up one or two decades of your life.
[40:11] Walk all alone into a prison for someone else.
[40:14] I… I wouldn’t have been alone.
[40:22] I envy you.
[40:24] You envy me?
[40:27] Had myself a little heart attack about six months ago
[40:29] on the courthouse steps.
[40:30] Not this courthouse…
[40:32] I never would have known.
[40:35] Funny thing is, I was lying there,
[40:39] ridiculous pain, middle of the day,
[40:42] people… walking by.
[40:47] Mm-hmm.
[40:50] And I looked up and I didn’t see any angels,
[40:53] I didn’t see…
[40:55] some glorious white light.
[41:00] I just saw a patch of blue sky.
[41:06] I was dying in the middle of New York City…
[41:10] and I was all alone.
[41:13] Ah.
[41:16] Yeah, I envy you.
[41:19] You’re never alone, are you?
[41:23] No, I’m not.
[41:28] You know, Dr. Bull,
[41:30] you could have that, too.
[41:33] There’s always a place at the church for you.
[41:36] You know, I’d be pleased to help you find the way.
[41:40] Well, that’s a very tempting offer, Father.
[41:44] The thing is, as I’m sure you know,
[41:48] God moves people in mysterious ways.
[41:50] Uh-huh.
[41:51] The way he moves me, I just cannot
[41:54] drag my butt out of bed on a Sunday morning.
[41:56] But like you said…
[41:59] who are we to question how God works?
[42:03] You know you’re going to hell, right?
[42:06] Yup. Already booked my suite.
